These Terms and Conditions (“Agreement”) govern the listing and sale of artwork by participating artists (“Artist”) through the PsyHibit website, operated by Junasty Inc. (“PsyHibit,” “Junasty,” “we,” “us”).

By submitting artwork for listing, the Artist agrees to the following:

1. Ownership & Authority

The Artist confirms that:

•⁠ ⁠They are the sole creator and legal owner of the artwork.
•⁠ ⁠The artwork does not infringe on any copyright, trademark, or intellectual property rights.
•⁠ ⁠They have full authority to sell the work.

2. Listing & Promotion

2.1 Junasty reserves the right to:

•⁠ ⁠Approve or decline any artwork for listing.
•⁠ ⁠Edit descriptions for clarity, formatting, or consistency.
•⁠ ⁠Promote the artwork through the website, social media, email marketing, or other promotional channels.

2.2 Listing artwork on the website does not guarantee a sale.

3. Sales Process

3.1 If a buyer expresses interest:

•⁠ ⁠The Junasty team will communicate with the buyer.
•⁠ ⁠Junasty will issue a payment link to the buyer.

3.2 Upon successful payment:

•⁠ ⁠PsyHibit/Junasty will retain a *10% commission plus applicable HST on the commission amount*.
•⁠ ⁠The remaining balance will be sent to the Artist via e-transfer within a reasonable timeframe (typically within five (5) business days after payment has cleared).

4. Artist Responsibilities

4.1 The Artist is solely responsible for:

•⁠ ⁠Packaging
•⁠ ⁠Shipping, delivery, or arranging pickup
•⁠ ⁠All shipping costs
•⁠ ⁠Insurance during transit
•⁠ ⁠Tracking and delivery confirmation

4.2 All logistics and costs related to delivery are the Artist’s responsibility.

4.3 PsyHibit/Junasty is not responsible for:

•⁠ ⁠Damage during shipping
•⁠ ⁠Delays
•⁠ ⁠Lost packages
•⁠ ⁠Installation
•⁠ ⁠Post-sale disputes

5. Customer Complaints & Liability

5.1 All post-sale matters, including:

•⁠ ⁠Complaints
•⁠ ⁠Refund requests
•⁠ ⁠Quality concerns
•⁠ ⁠Shipping disputes

are the sole responsibility of the Artist.

5.2 The Artist agrees to handle all customer service directly and professionally.

5.3 PsyHibit/Junasty acts solely as a marketing and payment facilitation platform and assumes no liability for the artwork, transaction outcome, delivery process, or any post-sale issues.

6. Taxes

6.1 The Artist is solely responsible for:

•⁠ ⁠Reporting all income from artwork sales
•⁠ ⁠Determining whether HST/GST applies to the sale of their artwork
•⁠ ⁠Charging HST/GST where legally required
•⁠ ⁠Registering for an HST/GST number if required by law
•⁠ ⁠Collecting and remitting any applicable taxes to the Canada Revenue Agency (CRA)
•⁠ ⁠Ensuring compliance with all local, provincial, and federal tax laws

6.2 PsyHibit/Junasty does not withhold taxes on behalf of the Artist and does not assume responsibility for the Artist’s tax obligations.

7. Commission

7.1 Commission is calculated on the final sale price of the artwork before any shipping fees.

7.2 Commission and applicable HST on the commission are non-refundable once a sale has been completed.

8. Termination

8.1 Either party may request removal of artwork from the website at any time.

8.2 Removal does not affect completed sales.

9. Indemnification

The Artist agrees to indemnify and hold harmless Junasty Inc., PsyHibit, and their directors, officers, affiliates, and representatives from any claims, damages, losses, liabilities, or legal disputes arising from:

•⁠ ⁠Copyright or ownership disputes
•⁠ ⁠Product defects
•⁠ ⁠Delivery issues
•⁠ ⁠Customer complaints
•⁠ ⁠Tax obligations

10. Acceptance

By submitting artwork and participating in online listing, the Artist confirms that they have read, understood, and agree to these Terms and Conditions.
